Licensor = Producer selling track
Licensee = Client
Non-exclusive = The track is leased to the client and not owned.
Exclusive Rights = The track is sold to only one client to use in all projects.
Leasing (non-exclusive) License
Leasing rights lets the purchaser use the beat for one profitable project. The purchaser can sell up to 50,000 copies of their product. Leasing rights can be re-sold to more than one client.
The musical production is now and remains the property of the Producer and is leased to the user for one profitable project.
This lease expressly forbids resale or other sale or distribution in any form (CD, web, tape, or file). You cannot sell or give the production away. Any usage not specifically allowed by this lease, including but not limited to any usage by an unlicensed individual or organization, will be prosecuted to the maximum possible extent under law.
The Buyer will receive an encoded MP3 file of the track. The track file will be delivered digitally.
Leasing rights allows the Buyer to use a song created with the track for ONE profitable project. This recording can then be distributed at the Buyer’s price for up to 50,000 copies. Selling more than 50,000 copies means the Buyer must acquire a new license (non-exclusive or exclusive rights).
The Buyer may also use the beat for non-profit promotional use or demos.
Upon purchase the Buyer will be granted non-exclusive rights to the beat. In the event that someone buys exclusive rights to the beat the Buyer has leased, the Buyer’s rights shall stand.
If the Buyer chooses to use the finished song for an album, the Buyer must contact the Seller in order to configure royalty percentages.
Upon purchasing leasing rights, the Seller still owns the beat and the Seller is able to resell the beat to any other party until exclusive rights have been purchased.
Exclusive License
Exclusive rights lets the purchaser use the beat for any and all profitable projects. These rights can only be sold to one person. Once the beat is bought exclusively it is removed from the page/website and cannot be sold again.
RIGHTS GRANTED TO THE BUYER
Buyer does have the worldwide, exclusive, transferable right for the use of the Music as long as additional audio/visual performances are recorded with our musical compositions (hereinafter referred to as “synchronization”). The Buyer is granted permission to sell or broadcast only in synchronization or mechanical reproduction with other visual or audio performances (vocals) added by Buyer. Rights include distribution of phono-record demos created using the Seller’s compositions. Buyer has distribution, performance and radio rights as long as they adhere to the following restrictions. Buyer understands that the rights that are being granted to the Buyer in this Agreement are exclusive and that the Seller will have the no authority and no right to issue other parties the right to use the Original Instrumental Composition that is being licensed in this agreement.
1) The License expressly FORBIDS resale or other distribution of the Producer's compositions, either as they exist or any modification thereof. You CANNOT sell, loan, rent, or lease any of the compositions sold or their rights under the Producer to another user (example - Record Label, another production company, another producer).
2) The Buyer understands that the Original Instrumental Composition that is being licensed in this agreement does not contain any unapproved samples. The Buyer also understands that they are responsible for clearing all samples that they choose to use and that the Seller cannot and will not be held liable for the misuse of any sampled material that the Buyer uses in conjunction with the Original Instrumental Composition that is being licensed in this agreement.
3) The Buyer understands that The Seller maintains 100% copyright and ownership of the Original Instrumental Composition that is being licensed in this agreement, and the Buyer has the right to sell or license the rights to the Original Instrumental Composition whether in whole or part to any other party with written permission from the Seller.
4) Use of the Producer's compositions in isolation (without synchronization of vocal performance) is not permitted without obtaining a special Multimedia license directly from the Producer. If you are interested in using the Producer's compositions for Radio Broadcast, Commercial Advertisement, Television Broadcast, Video Games, Internet, On-hold & In House Background Music, or film Soundtracks you must contact the Producer directly in order to be granted such license
PERFORMANCE AGREEMENT
1) Buyer has the right to perform with the Producer's music in public (Live concerts, radio, television, etc.)
2) Buyer is the sole owner of the music referred to in this agreement. Buyer has no ownership of the Producer's copyrights.
